 EURALIUS und OPDAT, die Justiz Missionen der EU in Albanien (   Die Frage ist nun seit über 10 Jahren, warum man nur Dritt klassige Leute entsendet, welche oft nur Politologie studiert haben und keine Job finden. Nur die Dümmsten, findet man mit Parteibuch noch auf solchen Missionen.

Albanian President Bamir Topi says that the immunity that high state officials enjoy in Albania serves as protective shell for corrupt politicians. 

No immunity in front of the law

The Albanian President, Bamir Topi, and the EU Ambassador in Tirana, Ettore Sequi, declared that this reform is a challenge for all political parties, since there is needed a common will for realizing it.

“The immunity, rather than an institution established for allowing high rank officials to exert their duties freely, has often turned into a protecting shield of irresponsibility and corruption. The high rank officials have often used immunity as a shield against legal prosecution for their violations, instead of being used as a means given by the Constitution for guaranteeing their contribution to the society. Time has come to make equality in front law not only a mere principle provided by the Constitution, but a concrete achievement of this principle. Let us all join to these European positive developments”, the President declared.

While ambassador Sequi declared:

“Immunity must be understood in the right way, since it doesn’t give a special privilege to judges and high rank officials above the law. Immunity means that the high rank officials and judges will have their freedom to act independently, while they must preserve the big responsibility for their accountability.”

The suggestions for the immunity system reformation have come from two EU projects for the judicial system, PACA and EURALIUS, with a cost of 4.4 million EUR.

EURALIUS representatives suggested that the general immunity should be removed. Judges must respond in front of the law for their infringements. The judges of the Constitutional Court must not profit from the general immunity, but from a procedural regime, similar to what has been given to the MPs.

The propositions of the European Council and the European Union require 93 votes for removing the mandate of an MP. The propositions also suggest that if the MPs are caught in flagrance. The immunity will be removed immediately. According to the EURALIUS propositions, the ministers must also be without immunity. The Ombudsman, the head of the Supreme State Audit and the Central Election Commission members should also work without immunity.

The Democratic Party head of Parliamentary Commission of Laws, Ilir Rusmali, guaranteed for the readiness of the ruling party to make the constitutional amends for removing the immunity of the MPs.

“We have declared more than once that the Democratic Party is ready to vote all constitutional amends, if there is a project for the immunity”, Rusmali declared.

The Socialist MP, Fatmir Xhafaj, vice Chairman of the Parliamentary Commission of Laws, reminded the early efforts of the Socialist Party on this matter, underlining that the Albanian officials have escaped punishment for corruption even without immunity.

“We reconfirm our position that it is indispensable to limit the immunity of the MPs and of high rank officials. The immunity is realized through Constitutional changes”, Xhafaj declared.

Nano: Majority fears possible new Party by the President

The prolonged personal debate between the Albanian President, Bamir Topi, and the Parliament Speaker, Jozefina Topalli, was the center of a debate in Top Channel’s program “Shqip”, where the host Rudina Xhunga invited the former Minister, Besnik Mustafaj, the analyst Mustafa Nano and the politician Aleksander Biberaj.

“The danger comes from the excessive appearance of our institution leaders as protagonists. This damages the state institutions and the foundations of democracy, because it puts the political protagonists before the institutions to which they serve. The Albanian spokespersons speak on behalf of their leaders, not of the institutions they represent”, Mustafai declared.

Mr. Nano added that the declaration of Bamir Topi for opening a new right centered party after his mandate as the Albanian President has created fear among the Democratic Party leadership, since this would divide their ruling party and would help the opposition Socialists. But Nano added that the goal of Bamir Topi’s party will be that of reforming the Albanian right wing, rather than helping the opposite left centered front.

Aleksander Biberaj, former Democratic Party MP, also accused the Parliament Speaker (Josefin Topalli) of frequently disrespecting state figures, such as Presidents and MPs, saying that it also reflects her education and culture.  http://www.top-channel.tv/english/artikull.php?id=3201në tr

Loans, banks tighten up conditions

Taking a bank loan has become even more difficult in the third trimester of the year. A recent survey of the Albanian Bank shows that private banks have tightened up loan conditions, since they perceive an increased danger in the economy. 

The bank experts say that there are two main reasons that are obliging them takeing these measures with the business and consumer loans.

First, there is the situation of bad loans, almost 18% of the total. The second reason is related with a negative evaluation that the banks received for the macro-economic situation in the country. To handle these two risks, the banks have increased the interest rates for loans that they consider as risky, and also the request for the mortgage guarantees.

On the other hand, the individuals and businesses seem hesitant. The survey says that the demands for loans have decreased during July and September. Experts say that this situation will continue even harder during the last trimester of this year, especially for big businesses. The loans given for the economy have increased with 12.7% in the first eight months of 2011, compared to the same period of one year ago.

New law for property registration

The government has prepared a new law for registering the real estate assets, which obliges the Registration Office to financially reward all businesses and individuals if there will be fake documents released by this agency. 

“If the registration office has given an information and the applicant has benefited a fake information, the Registration Office must respond for the damages that have been caused to the subject”, says the Minister of Justice, Eduart Halimi.

The bank representatives, who are directly affected by the insecurity of property ownership titles, have welcomed the law.

“Our biggest problem is that of the safety of property titles. If we give a loan against a given property title, we must be sure that this property title will guarantee our money”, says Sayan Pencapligil.

The law also reduces the procedures for receiving ownership titles, by digitalizing the archive.

“The information will be taken within a minute by the Registration Office, which makes it easier and faster for the banks to verify the property titles and to approve a loan or not. It also cuts the expenses”, Halimi explains.

The digitalized archive will offer information not only for banks, but also for notaries, who will make the procedures for the citizens.
