Pyramid, Constitution Violation

The decision for demolishing the Pyramid and for building the new Parliamentary Complex is against the Constitution and the Parliament protocol.

Socialist Party MP Erjon Braçe based these accusations on Article 82.12 of the Albanian Constitution. This article states that the laws proposed should be accompanied by the report that justifies the financial expenses and its implementation. The second clause of this article states that any non-governmental draft-law that increases budget expenses or that reduces revenues should not be approved without the opinion of the Council of Ministers, which must be given within 30 days from the date when this draft-law is filed. This article is also present in the Parliamentary Regulation.

“The Commission of Laws does not justify the financial expenses needed for the implementation for the draft-law that was presented and approved yesterday. The Council of Ministers has not presented in the Parliament the opinion regarding this project”, Braçe declared.

Socialist MP Erjon Braçe discovered that the Albanian Parliament addressed an opinion request to the Council of Ministers on March 2011, with a draft that is different to the current. Despite the difference, the common thing is that on both cases, the answer was not made public, although it was a legal obligation to declare the final value of the object, the way it will be billed, all prices per unit and the way in which the procurements will be performed.

“What has happened with the first draft of this group of MPs registered in the Parliament, sent to the Council of Ministers as a legal initiative? The project is different to the one that is now being voted in the Parliament”, Braçe declared.

Mr. Braçe referred to the declaration of one of the majority MPs, who emphasized in the Commission of Laws that the Parliament can allow the luxury of excluding itself from taxes.

“By stealing, they left our city under the administration of Lulzim, but the problem is that the taxes will be paid by Tirana’s citizens”, Braçe declared.

According to Erjon Braçe, the philosophy of this law in this time of economic crisis is not normal.

New Parliament’s burned bills

The decision for the construction of the new Parliament has other bills that have been paid by the citizens, but that have gone in vain. The government has spent 79 million ALL for the reconstruction of the current Parliament. Even in this time, the Parliament Speaker promised more investments in the current Parliament building. The construction of a new Parliament means that this money was spent in vain. But this is the smallest cost, compared to the financial chaos of this project. The construction of the new Parliament devaluates a 5 million EUR investment undertaken by the Ministry of Culture at the Pyramid, for turning it into a National Theater. Until now, 30% of the works for the theater have finished. By interrupting the works, due to the fact that this building will be demolished for the new Parliament, it means that not only the money spent for 30% of the works went in vain, but also the remaining 70% of this fund.

If the Pyramid will be demolished for leaving space to the new Parliament, architects say that the government will have to pay 10 million EUR for this process.

And there is also another bill that the government has paid in vain. In 2007, this ruling party voted the construction of a new Parliamentary Complex within the space of the Parliament Assembly, the main building of the former communist party. The winning project was selected through a national competition between 108 architectural studios. The winner was a Swiss project.

According to this studio, for realizing the project of the new Parliamentary Complex, the Albanian government has spent 1 million EUR. Even this money of the Albanian tax payers went in vain, and no one has ever answered why.Brussels, scanning Albania

The joint Stance of 27 EU member countries is analyzing the Albanian political situation before and after the local elections, before the meeting of the third Council of Albania-EU Stabilization-Association, which will be held next week in Brussels. Politics

The European Union underlines that the well-functioning of the Democratic Institutions is an essential aspect of the political criteria and in the EU membership process. EU underlines the importance of the reestablishment of the entire Parliamentary activity, based on a stable and constructive dialogue between all Parties. This is a key priority of the Opinion. The political stalemate is withholding the most important reforms that have been required for the road towards EU membership. The full function of the Parliament is vital for the credibility of the Democratic maturity in Albania.

Stalemate

EU expresses its regret for the continuity of the political stalemate and the confrontational political climate that derived by the disagreements about the result of June 2009 general elections, a dispute that was further fueled by the January 21st events and May 8th local elections.

EU repeats the appeal that they are ready to contribute with any means to solve the political stalemate. But they emphasized that first, it is a responsibility of the political leaders to decide on the future of their country, the personal agendas of the political parties, and to find a solution to this crisis. The political leaders must undertake all necessary steps and must take all necessary actions for this purpose.

As for the elections, the EU states that despite the irregularities, the electoral process was within the norms, until the announcement of the preliminary result, which triggered the problems. This part of the 26 pages long document, secured by Top-Channel, can change depending on the further decisions and developments in Tirana, until the day of this meeting.

Elections

EU repeated its appeals that the electoral reform and the elections are key priorities to the Opinion.
EU notes that despite some irregularities, the voting process during May 8th elections was generally calm. The counting process was slow and although it was followed by some tensions, it was generally within the norms.

EU expresses its regret for the deterioration of the situation and the increased tensions that followed the lack of announcement of the preliminary results by the Central Election Commission, and especially after its decision for counting miscast ballots, which was confirmed by the Electoral College.

EU expects the following appealing process to be fair, transparent, and to be held independently and in full accordance with the current legal structure.

EU emphasized the need to implement all recommendations given by OSCE-ODIHR after 2009 General Elections, and the preliminary recommendations of May 2011 Local Elections (including the final recommendations, soon after they will be published) for improving the practices of the past and for guaranteeing a full consistency with EU and international standards for democratic elections.

In general, EU praised the approval of new laws, except those that require a qualified majority, although the government has not performed the necessary consultations with the civil society and interest groups. However, things always get blocked in the implementation. Meanwhile, they repeat the appeal for creating a public and independent administration. The judicial system keeps being criticized for incorrect performance, and EU does not forget to remind the necessity to conclude the investigations of January 21st events and the punishment of the coulprits.

The Administration

As for the Reforms on the Public Administration, EU underlines the need for creating an independent civil service, professional, based on merits and free from political influences, as a key priority of the Opinion. EU expressed its concern on the limited progresses that the Albanian administration has made in this field. The increase of supervisions, efficiency and the implementation of the punitive measures on time must be implemented and reported regularly by the Albanian authorities. There is the need of guaranteeing a reinforcement of the Civil Service law and for implementing the strategy of the public administration reform, including the a review of the existing legal structure, the reinforcement of the authority and administrative capacities of the Public Administration Department, and improving the transparency for civil service recruitments. The new law for the civil service is still in the initial phase.

Judicial System

EU underlines that the rule of law and its independence, impartiality, transparency, efficiency and responsibility of the judicial system are key elements for the reassessment of the political criteria of EU membership. The judicial authorities must be able to work independently, without any inadequate interference or obstacles. EU emphasizes that they will continue to closely monitor the investigation of January 21st events. It is essential for these events to be fully investigated by the right authority of State Justice; the investigations must be followed by the prosecution and all who are responsible must take the deserved punishment.

As for the media, EU requires visible evidence that guarantee its freedom and independence.

MEDIA

As for the freedom of speech, EU notes that the pressures from politics and businesses continue to damage media independence. The covering of May 8th elections by the media marked an improvement compared to previous practices, but there are still concerns on the impartiality o the news. EU repeats the appeals that the Albanian Parliament must pass amends in the Penal Code for including libel and insult in the crimes list. EU wants to remind Albania the necessity of supporting media freedom and independence. Media freedom is a basic pillar in well governing and accountability.

Lejet e ndërtimit u dyfishuan këtë vit

Lejet e ndërtimit të dhëna në Shqipëri gjatë periudhës janar-mars 2011 qenë 2.5 herë më të larta se sa në tremujorin e parë të vitit 2010, bëhet e ditur nga një raport statistikor i publikuar nga Instituti i Statistikave.

Lejet e ndërtimit pësuan rritje të konsiderueshme prej 57 përqindësh gjatë vitit 2010 në krahasim me vitin 2009, por kjo rritje qe ende shumë e ulët në krahasim me ecurinë e tyre në tremujorin e parë të këtij viti.

Gjithsej 503 leje ndërtimi me sipërfaqe të përgjithshme prej 883 mijë metra katrorë sipërfaqe banimi apo shërbimesh u dhanë gjatë muajve të parë të këtij viti kundrejt 137 lejeve me sipërfaqe prej 204 mijë metrash katrorë të dhëna në të njëjtën periudhë të vitit 2010.

Durrësi mban numrin rekord të lejeve të dhëna, 105 të tilla me 73 mijë metra katrorë të dhëna këtë vit, një rritje prej katër herësh në krahasim me 28 leje ndërtimi me sipërfaqe 15 mijë metra katrorë të dhëna një vit më parë.

Në vend të dytë është Qarku i Gjirokastrës, (lejet më të shumta u dhanë në Bashkinë e Sarandës) me 85 leje të reja dhe 64 mijë metra katrorë sipërfaqe të programuar apartamentesh.

Lejet e dhëna në Korçë, ndonëse qenë vetëm pesë të tilla, kanë një sipërfaqe të planifikuar ndërtimi prej 289 mijë metrash katrore.

Edhe Vlora, ndonëse me një numër të kufizuar prej 48 lejesh, ka një sipërfaqe të programuar ndërtimi prej 255 mijë metrash katrore.

Shkaku kryesor i këtij bumi lejesh ndërtimi besohet se janë zgjedhjet e 8 majit, ku shumë kryebashkiakë nën frikën e mosrizgjedhjes e lëshuan dorën me leje ndërtimi.

Kompanitë e ndërtimit janë ankuar shpesh gjatë dy viteve të fundit për ecuri të keqe të shitjeve, si pasojë e krizës, por këto vështirësi duket se nuk e penguan të tërheqë një sasi rekord lejesh ndërtimi në muajt e fundit të vitit 2010 dhe muajve të parë të këtij viti.

Pyramid, German ambassador: A wide public debate

Western diplomats accredited in Tirana are not staying indifferent to the public debates that spurred after the law for the demolition of the Pyramid was passed by the Albanian Parliament, which has been strongly opposed by Tirana citizens.

“The Albanian society should be careful about buildings that have been constructed during communism, such as the Pyramid, and there is no reason to take radical decisions.”

This is the message of the German ambassador in Tirana, Karola

The German ambassador is the second diplomat that gives a similar comparison with what happens in her country with issues of this kind.

Two weeks ago, the Danish ambassador in Tirana, Mr. Jensen, declared that the Pyramid is a landmark for Tirana, and its demolition would be a very big mistake in the Albanian history.

Ndërtimi i Kompleksit të ri parlamentar është peng i bisedimeve me qeverinë e Arabisë Saudite. Qeveria shqiptare mësohet t’i ketë kërkuar arabëve që të ulin interesin e kredisë që do lëvrohet për nisjen nga puna të ndërtimit të këtij projekti. Por burime brenda qeverisë bëjnë të ditur se momentalisht bisedimet janë të ngrira mes dy qeverive për faktin se Arabia Saudite nuk pranon të ulë masën e interesit të kredisë. Arabët kanë marrë përsipër financimin e parlamentit shqiptar por pika ku palët po hasin vështirësi është pikërisht tek interesi që do të paguajë Shqipëria. Për këtë fakt ende nuk ka një vendim përfundimtar ndërkohë që pritet që bisedimet të nisin sërish në muajin shtator mes ministrisë së financave të Shqipërisë dhe asaj të Arabisë Saudite. Mësohet se është vet ministri Ridvan Bode ai që po këmbëngulë për uljen e këtij interesi i cili nëse mund të formalizohej përmes një marrëveshje mes dy qeverisë do ta bënte më te lehtë shlyerjen e kredisë tek arabët nga ana e qeverisë shqiptare. Pas mbylljes së negociatave mes dy parlamenteve, atë të Shqipërisë dhe Arabisë Saudite, bisedimet dypalëshe kanë arritur në nivel qeveritar për faturën financiare të parlamentit të ri. Përfaqësuesi i Kuvendit shqiptar, deputeti demokrat Sheferdin Shehu, konfirmoi para disa ditësh për “Gazeta Shqiptare” se parlamenti ka mbyllur procesin e negociatave me homologët arabë ndërkohë që tashmë bisedimet zhvillohen në nivel qeveritar. Sipas tij është Ministria e Financave, ajo që po negocion me qeverinë e Arabisë Saudite për faturën financiare. Arabia Saudite ka marrë përsipër dhënien në formë kredie të parave që do të ndërtojë Kuvendin e ri të Shqipërisë. Kosto financiare e ndërtimit të kompleksit të ri parlamentar është parashikuar të jetë 100 milionë euro, por fatura e saktë e ndërtimit të parlamentit të ri nuk është parashikuar e llogaritur në projektligjin e miratuar në Kuvend. Parlamenti votoi në fund të muajit korrik pro ngritjes së kompleksit të ri parlamentar, duke i hapur kështu rrugë prishjes së Piramidës. Kuvendi i Shqipërisë, sipas një njoftimi zyrtar të disa ditëve më parë, do të lidhë një kontratë me studion e projektit fitues të konkursit ndërkombëtar të idesë për ndërtimin e kompleksit dhe për hartimin e projektit të zbatimit në të gjitha fazat. Kryeministri Sali Berisha pati garantuar shqiptarët se qeveria nuk do të shpenzojë asnjë qindarkë më tepër sesa do të shpenzonte për rikonstruksionin e godinës aktuale të saj. Sipas tij rikonstruksioni i godinës aktuale të kuvendit shkonte 25 për qind më shumë se sa ndërtimi i godinës së re të parlamentit së bashku me ndërtimin e godinës së Gjykatës së Lartë. Ai gjithashtu theksoi se, tani është koha për ndërtimin e godinës së re, sepse ambientet aktuale të parlamentit janë të shpërndara në vende të ndryshme. Kuvendi i Shqipërisë miratoi në fund të sesionit të kaluar ligjin që i hap rrugë ndërtimit të këtij parlamenti, i cili nuk mori votat e opozitës.

    Kosovo intellectuals oppose Pyramid demolition
    The approval of the Albanian Parliament for demolishing the “Pyramid” in Tirana has prompted new reactions from the Kosovo capital, Prishtina.

    After the scholar Rexhep Qosja, writer and university professor Agim Vinca also reacted against the demolition of the Pyramid building. In an interview for Top Channel, prof. Vinca declares that the Albanian Parliament sentenced to death a monumental object, right in the heart of the Albanian capital.

    “The current Parliament Members have turned one deaf ear. It is never too late to leave space to the reason, it is never too late to change and find another solution for a decision that might have serious consequences in the confrontational and very unstable political reality in Albania. This would mark a better celebration of the 100th independence anniversary, and would save the Pyramid as an valuable architectural object, as the specialists have noted”, Vinca declared.

    Prof. Vinca added that the Albanian politicians are blinded by the overconfidence given by the political power. According to him, the idea of demolishing the “old” and “ the war against ghosts” is not something that the Albanian leaders want to hear, and much less take in consideration.

    “Tirana is the capital city not only for Albania, but in some way for all Albanians. We have many emotional ties and memories to this city, and I think that the oligarchy in Tirana must take in consideration the public opinion, which, as far as I know, was against demolition, because this is a syndrome that has been inherited by the past, a syndrome that is not democratic in its core. It is some kind of cultural and political vandalism”, Vinca declared, emphasizing that history itself will judge the ones who undertook such a step.

    Rozafa Basha, an expert of urban matters, is also against the demolition of the Pyramid.

    “I think that this is a wrong decision. It is an inseparable part of the space and the general view of the center of Tirana, and it perfectly organizes the space around itself in relation with the citizens. The object planned to be built only creates a political space, and that’s all. I would not sacrify public space for a state institution that already exists. There might be other places to build it”, Basha declared.

    Rexhep Qosja, one of most well-known Kosovo scholars has strongly opposed the demolition of the Pyramid. He even declared that this is a unique example and the ugliest action that could happen in the history of a country that pretends to walk towards the European Union.

    Pyramid demolition, architects and publicists at the Presidency
    Architects, publicists and intellectuals attended a meeting with the Albanian President Bamir Topi for the Pyramid issue, asking this institution to make everything possible to aviod the demolition of the building.

    After the meeting, the publicist Ardian Klosi declared that they planned a memorandum that explains why the Pyramid should not be demolished.

    “The President must be consulted with experts about the law that passed in the Parliament”, Klosi declared, inviting Tirana citizens to participate in a celebration in front of the Pyramid for raising awareness against the demolition.

    President doesn’t decree the Pyramid
    Wednesday was the last deadline for the Albanian President to decree or to return in Parliament the law for the construction of the new Parliamentary Complex.

    The new complex will be built where today stands the International Cultural Center. The plan for razing this building down has provoked a wide reaction among the Albanians and foreign diplomats in Tirana, even by the EU Commissioner for Enlargement, Stefan Fule, from the European Commission.

    In face of such a sensitive matter, the President chose to not decree the law. The law will be enacted without the signature of the Head of the State, as the Constitution provides.

    But for Artan Lame, this is a strong message for the Prime Minister.

    “The President is the one who expresses the national unity, while the Prime Minister expresses the difference between two camps. Maybe the President did not want to take sides, and has found a middle solution by not decreeing the law, and by not returning it to the Parliament. This way he will not fulfill the desire of the President for dividing people who are on his side or against him”, Lame declared.

    Lame underlines this issue has a wide consensus, as never before.

    The people of Tirana gave its message in all possible ways. Albania’s greatest figures, the international community, the former Mayor, the current Mayor and the President also gave their message. I don’t know who has to talk to the Prime Minister and convince him for abandoning this craziness”, Lame declared.

    Fule-Lajcak: “Pyramid” endangers Top-Channel

    In response of the concern that was raised by Top-Channel, the EU Commissioner for Enlargement, Stefan Fule, and EU Special Envoy for Albania, Miroslav Lajcak, declared that they are aware about the difficulties that this TV is facing for its premises, i order to continue an uninterrupted broadcast of its programs.

    Auch die Gelder der Islamischen Banken sind gesperrt für die Albaner Mafia Regierung. Selbige versucht nun bessere Konditionen zuerlangen, für einen Kredit.     Kompleksi i ri parlamentar, ngecin negociatat me arabëtTIRANE-Ndërtimi i Kompleksit të ri parlamentar është peng i bisedimeve me qeverinë e Arabisë Saudite. E perditshmja Gazeta Shqiptare ben te ditur se qeveria shqiptare mësohet t’i ketë kërkuar arabëve që të ulin interesin e kredisë që do lëvrohet për nisjen nga puna të ndërtimit të këtij projekti. Por burime brenda qeverisë bëjnë të ditur se momentalisht bisedimet janë të ngrira mes dy qeverive për faktin se Arabia Saudite nuk pranon të ulë masën e interesit të kredisë.

    Arabët kanë marrë përsipër financimin e parlamentit shqiptar por pika ku palët po hasin vështirësi është pikërisht tek interesi që do të paguajë Shqipëria. Për këtë fakt ende nuk ka një vendim përfundimtar ndërkohë që pritet që bisedimet të nisin sërish në muajin shtator mes ministrisë së financave të Shqipërisë dhe asaj të Arabisë Saudite.

    Kosto financiare e ndërtimit të kompleksit të ri parlamentar është parashikuar të jetë 100 milionë euro, por fatura e saktë e ndërtimit të parlamentit të ri nuk është parashikuar e llogaritur në projektligjin e miratuar në Kuvend. Parlamenti votoi në fund të muajit korrik pro ngritjes së kompleksit të ri parlamentar, duke i hapur kështu rrugë prishjes së Piramidës. Kuvendi i Shqipërisë, sipas një njoftimi zyrtar të disa ditëve më parë, do të lidhë një kontratë me studion e projektit fitues të konkursit ndërkombëtar të idesë për ndërtimin e kompleksit dhe për hartimin e projektit të zbatimit në të gjitha fazat. Kryeministri Sali Berisha pati garantuar shqiptarët se qeveria nuk do të shpenzojë asnjë qindarkë më tepër sesa do të shpenzonte për rikonstruksionin e godinës aktuale të saj.

    Students defend the Pyramid

    The future of the Albanian architecture has protested against the state institutions for leaving the Pyramid without being decorated for the winter holidays.

    The students bought the decorations with their money and declared that this part of the city center, a few meters from the Prime Minister’s Office was left in total darkness.

    During a peaceful meeting in front of the Pyramid, they protested against the demolition of this building.

    “Our first goal is to show that this building is as important as the others for the collective memory of this country, and that it is absurd to leave it in oblivion. Not only us, but every student is against the demolition of the pyramid”, declared Megi Maria Nikolla, member of the New Architect’s forum.

    The New Architect’s Forum has been helped by the Architect’s Association and Rally Albania.

    They declared that they will continue other activities for protecting the pyramid and for reminding to the ones that decided to demolish it, that the Pyramid has architectural and historical values for all generations.
